In some cases, you might find the procedure rather long and complex before you are actually able to come into your inheritance.
There are five different steps we must take together in order to settle the estate.
5 key steps
1 - The family tree is given to the notary
A family tree can be long and complex to develop depending on the number of heirs found.
2 - The statutory declaration (acte de notoriété) must be signed
In the light of the family tree drawn up by Coutot-Roehrig, the notary drafts a statutory declaration setting out each person’s rights.
However, in French départements La Moselle (57), Le Bas-Rhin (67) and Le Haut-Rhin (68) which are governed by local laws, an heir must sign a formal declaration in order to obtain a certificate of inheritance from the Court.
3 - The deceased’s estate is determined

Under the proxy you give us, we are able to represent you at every step in the process, thus avoiding you trips and formalities.
Properties are put on sale after obtaining the prior written agreement of all the heirs.
4 - The estate is settled by the notary
- Liquid assets are cashed
- Properties are sold
- Debts are paid off
- The declaration of estate is signed and registered
- Inheritance tax is paid concomitantly
In their capacity as public officers, notaries are responsible for the formalities and for drafting the various inheritance deeds.
Our role is to support them to facilitate the probate process.
5 - Distribution of funds
Upon receiving the funds sent by the notary, we pay you your corresponding share, minus our fees.
